Voting Rights Act: Is major portion outdated? Supreme Court to hear arguments.

So why is the US Supreme Court being asked to declare a major portion of the landmark Voting Rights Act of 1965 unconstitutional?

On Wednesday, the high court is set to take up a legal challenge filed on behalf of Alabama?s Shelby County, alleging that Congress overstepped its authority when it voted overwhelmingly in 2006 to reauthorize Section 5 of the Voting Rights Act (VRA) for 25 years.

At issue in the case, Shelby County v. Eric Holder (12-96), is a section of the law that gives the federal government extraordinary power to prevent state and local governments from discriminating against minority voters by undercutting their political clout in elections.

In 1965, when the VRA was first enacted, many states, particularly in the Deep South, were actively working to prevent black and other minority voters from effectively exercising their right to vote. They had done it for decades through threats of violence, poll taxes, and literacy tests.

Congress outlawed those blatant tactics, but the discrimination continued in more creative and subtle ways.

To counter it, Congress enacted Section 5 of the VRA. It required certain jurisdictions with a demonstrated history of discrimination in voting to submit any changes in their voting procedures to the Justice Department or a three-judge panel in Washington for approval before any change could take effect.

The measure required federal officials or judges to examine the changes and determine if they were discriminatory or would otherwise have a detrimental effect on minority voting.

There is no dispute about the effectiveness of the measure. It worked well and continues to work well.

The question now is whether discrimination in voting ? nearly 50 years after the 1965 VRA was first passed ? continues to be so egregious as to justify the extraordinary measure of requiring certain targeted state and local governments to obtain permission from Washington before they are allowed to alter their own voting procedures.

When it was first passed, Congress authorized the extraordinary measure for five years. It has since been reauthorized four more times, including for 25 years in 1982 before the 25-year extension in 2006. But instead of reevaluating each covered jurisdiction based on whether or not there is contemporary evidence of discrimination, federal lawmakers decided to continue to rely on the original criteria used in the 1960s and 1970s to determine the most egregious jurisdictions in the country.

Many of the covered jurisdictions, Shelby County among them, insist this is unfair.

The central thrust of Shelby County?s argument boils down to one word: federalism.

Those challenging the constitutionality of Section 5 are asking the high court to strike a balance between Congress?s power to fight discrimination and the constitutional requirement that states be treated as co-equal sovereigns.

DNA a civil rights issue in Supreme Court case

WASHINGTON (Reuters) - In a case that spotlights the growing use of genetic data by law enforcement agencies, the Supreme Court will consider on Tuesday when a DNA sample may be taken from a suspect.

Police and prosecutors in Maryland suffered a major setback when the state's court of appeals ruled in April 2012 that Alonzo King's Fourth Amendment right to be free from unreasonable search and seizure was violated when he was required to provide his DNA upon being arrested.

Under Maryland law, samples can be taken from anyone arrested for a serious offense without police needing to get a warrant first. Police can then submit those samples to a national database to see if the suspect is linked with any other crimes.

The case being argued Tuesday focuses purely on samples taken after a suspect is arrested and charged with a crime, but not convicted of it. Samples taken from convicted felons are routinely submitted to the national database. That practice is not an issue in the case.

The sample King gave after a 2009 arrest in Wicomico County on two assault charges linked him to a 2003 rape. He was sentenced to life in prison after being convicted of the rape and was convicted of one count of misdemeanor assault on the 2009 charges.

His lawyers argue that the sample taken in the assault arrest should not have been used to link him to the rape.

The nine members of the U.S. Supreme Court will review the Maryland court ruling during a one-hour oral argument.

King has received full-throated support from civil liberties groups, which are concerned that the government has too few constraints in collecting DNA. At a minimum, police should be required to get a warrant, based on what lawyers call "individualized suspicion," that links a suspect to a particular crime, King's backers say. There was nothing linking King to the rape until after his DNA was taken and submitted to the database.

Maryland Attorney General Douglas Gansler, a Democrat, said in an interview that the state court decision "didn't make a whole lot of sense to us." He described the law enforcement community in Maryland as being "apoplectic" when the ruling came out.

"The importance of DNA to law enforcement cannot and should not be lost on the justices," Gansler said.

FIFTY STATES

Gansler and his law enforcement allies make a sweeping argument about the government's right to take DNA samples. They insist that the act itself - which takes the form of a swab of the inside of the cheek - is reasonable, and therefore permissible, under the Fourth Amendment, even when there is no warrant.

Factors to take into account include the minimal intrusion of the search and the interest of the state in identifying and supervising suspects before trial, the state's lawyers say.

State law enforcement groups, including the Maryland Chiefs of Police Association, filed their own brief in the case, noting that the collection of DNA from people who have been arrested "is a critical and effective modern tool."

A ruling in favor of King would cast into doubt 27 similar state laws and a complementary federal law. Every other state in the country, plus the District of Columbia and Puerto Rico, signed on to a brief in support of Maryland.

There are multiple benefits, California Attorney General Kamala Harris wrote in the states' brief.

The practice can help crack down on repeat offenders and prevent innocent people from being investigated as suspects, she wrote.

"These statutes make it possible for law enforcement to solve a vast amount of violent crime," Harris said.

GOVERNMENT OVERREACH

King's attorney, Kannon Shanmugam, said in an interview that there is a danger of government access to DNA expanding even further unless the circumstances in which it can be collected are curbed.

There are already 1.3 million arrested suspects and 10 million convicted people nationwide whose data has been collected, according to U.S. Federal Bureau of Investigation data. With more than 12 million arrests in the country each year, "what we will see is a vast expansion of individuals whose DNA is in the government's possession," Shanmugam said.

In a brief filed on behalf of the American Civil Liberties Union, attorney Michael Risher focused in part on the invasion of privacy that critics say DNA sampling constitutes.

"Beyond the fact of bodily intrusion, the scientific examination, combined with the indefinite retention of the actual DNA samples for later re-analysis, implicates fundamental privacy interests," Risher wrote.

As he prepares for the oral argument, Shanmugam, who has argued 12 cases before the U.S. Supreme Court, said he was not concerned that every state in the country had lined up against his client.

"It's not entirely surprising because all 50 states have DNA testing of some variety," he said. "We certainly think we have very substantial arguments as a matter both of law and public policy."

Don McNay: Life Lessons From a Street Wise Guy

A well-connected friend in New Orleans took me to the critically acclaimed Galatoires restaurant. A fine dining experience at one of the top restaurants in the United States.

My friend has a business relationship with the restaurant and knew everyone there. He asked for John, an entertaining 40-year-old veteran waiter, to serve us. My host insisted on paying for lunch, but I insisted on leaving the tip.

After handing John a large tip, as I reminded him of my name and my Kentucky roots, John and I parted as friends.

My wife becomes President of Ursuline Academy this summer. I am also in the process of opening an office for McNay Settlement Group in New Orleans. Both of us will have reason to entertain people at Galatoires.

When that happens, I know John will be my server. And my clients and friends will get the same VIP treatment that I got.

Building a relationship with a star professional at a world famous restaurant in a city where I am just getting established seems like a no brainer, but I see a lot of businesspeople with no brains. Servers are anonymous and faceless to them.

When those people go to dine, you will see them waiting in line for three hours to get a table.

My street wise father, Joe McNay, taught me that servers, nurses, plumbers and other support people can be the most important individuals in your life. Dad died 20 years ago this week at age 59.

Dad only made it to the 10th grade, but was smarter than any Ph.D in understanding human relationships. I always thought he should have been in politics. Instead, he was a bookie and a professional gambler.

Dad was not a millionaire, but he lived like one. His personality and connections gave him a tremendous amount of clout.

Dad fought bravely against prostate cancer and as the end drew near, I had one deathbed question.

Did Pete Rose bet on baseball?

I did not mention dad's friendship with Pete Rose in my 2008 book, Son of a Son of a Gambler: Winners, Losers and What to Do When You Win the Lottery.

At that time, Pete had not admitted he bet on baseball. I wrote the book like my dad was looking over my shoulder. I was not going to hurt or embarrass one of his friends.

I'm releasing an updated version of the book on my dad's 80th birthday, July 30th. Several people have died since the first release, so the book will be more revealing.

Dad's friends and clients were a who's who of the Cincinnati region, but in most circumstances, I never knew who was a client and who was just a friend.

I guessed that Pete was a client, but never knew for sure.

I knew Dad and Pete were good friends. During college, Dad gave me Pete's tickets and seated me next to a stunning young blond named Carol. At the time, Pete was married to a woman named Karolyn. When Pete came to bat, Carol would jump up and down and go crazy. I got the impression Carol and Pete were more than casual friends.

A couple of years later, Carol became Mrs. Pete Rose.

Even though he broke the law every day of his adult life, Dad was honest, but closed mouthed about his client list. Thus, asking him about Pete was something I only would do on his deathbed.

He told me that Pete never bet on baseball with him and only bet football for a short time. Dad thought that having a sports figure client like Pete was not a good business decision.

The bookie who took Pete's baseball bets should have made the same decision.

I still wasn't sure about writing about Pete until famed Knoxville trial attorney Donna Davis and her husband Ivan "Buzz" Beltz ran into Pete, who was signing his book, A Prison Without Bars, in Las Vegas.

They told Pete of their friendship with me, and Pete sent back a book with the following inscription.

"Don. Bingo Joe was the best. He owes me $100. Pete Rose, #4256."

I figured the cat was out of the bag at that point.

Last year, I met Dad's close friend, the legendary "Music Professor" Jim LaBarbara at the Montgomery Inn Boathouse in Cincinnati. Pete was there too. Pete immediately said the same $100 line he wrote in the book.

Then he stopped for a second and said, "You know, it is probably the other way around."

If there was any debt owed, it would have to be on Pete's side. Dad never missed paying off a bet. If Dad had to borrow money from everyone in town, he did. Paying promptly is what keeps a bookie in business.

There are a lot of ways I thought about paying tribute to dad on the 20th anniversary of his death, but I suspect giving the tip to John at Galatoires might have been the most fitting.

The lessons from a street wise man had been passed down through the generations.

I can't imagine a better tribute than that.

DC fire, EMS reviewing protocols after firefighters appear with Obama

D.C. Fire and EMS denied Friday night that three local firefighters are facing possible disciplinary action after appearing with President Obama during a press event.

Earlier this week the president was flanked by first responders as he spoke about the impact of sequestration. Kenneth Ellerbe, chief of D.C.'s Fire and Emergency Medical Service Department, told News4 the three members of DCFEMS who participated in the event may have violated department regulations.

?I didn?t know about it, the deputy mayor didn?t know about it, the mayor didn?t know about it," Ellerbe said. "There should be protocol followed anytime one of our employees representing the District of Columbia appears at a public event.?


The department released the following statement Friday night:

Contrary to reports in local media, the DC Fire and EMS Department is not considering any disciplinary action against uniformed personnel for appearing alongside President Obama. At the request of the Deputy Mayor for Public Safety and Justice, DC FEMS is simply reviewing its internal protocols for such appearances to ensure that both the Department and its employees are fully informed.

We fully support the efforts of President to highlight the essential and life saving work that our first-responders do every single day, and welcome his invitation for our members to participate. We're exceedingly proud of the men and women that wear the DC FEMS uniform, and thank the President for his support.

Ellerbe says the three firefighters have each been ordered to file a special report on the event detailing how they came to appear with the president and who authorized it.

Ed Smith, president of Local 36 of the firefighter?s union, said his office facilitated the appearance by the firefighters. ?The request came through the International Association of Firefighters,? Smith said, adding that it?s not the first time D.C. firefighters have been asked to appear with the president.

But he said, it?s the first time it?s been an issue. ?We?ve done this before. I would hope it doesn?t come to any discipline. They were supporting our president,? he said.

Ellerbe would not identify the department members involved, but one of those pictured is Lt. Robert Alvarado, who has been disciplined in the past by Ellerbe. In 2012 Alvarado was placed on leave after he wore a uniform with an outdated logo.

Ellerbe says requiring Alvarado and the others to explain why they attended the event in their dress uniforms is not payback for any previous incidents.

?There?s no payback, we don?t operate in a payback environment. I know folks say that but it?s not true.? Ellerbe insisted.

Ellerbe says none of the firefighters is facing termination, but added one of those involved is a woman who is new to the department and still on a probationary period.

Obama presses GOP to halt automatic spending cuts

WASHINGTON? -- Staking out his ground ahead of a fiscal deadline, President Barack Obama lashed out against Republicans, saying they are unwilling to raise taxes to reduce deficits and warning that the jobs of essential government workers, from teachers to emergency responders, are on the line.

Obama spoke as a March 1 deadline for automatic across-the-board spending cuts approached and with Republicans and Democrats in an apparent stalemate over how to avoid them.

Obama cautioned that if the $85 billion in immediate cuts -- known as the sequester -- occur, the full range of government would feel the effects. Among those he listed: furloughed FBI agents, reductions in spending for communities to pay police and fire personnel and teachers, and decreased ability to respond to threats around the world.

He said the consequences would be felt across the economy.

"People will lose their jobs," he said. "The unemployment rate might tick up again.?

"So far at least, the ideas that the Republicans have proposed ask nothing of the wealthiest Americans or the biggest corporations," Obama said. "So the burden is all on the first responders, or seniors or middle class families.?

House Republicans have proposed an alternative to the immediate cuts, targeting some spending and extending some of the reductions over a longer period of time. They also have said they are willing to undertake changes in the tax code and eliminate loopholes and tax subsidies. But they have said they would overhaul the tax system to reduce rates, not to raise revenue. Obama did win an increase at the start of the year when Congress increased the upper tax rate for the wealthiest Americans.

"The American people understand that the revenue debate is now closed," House Speaker John Boehner said in a statement Tuesday following Obama's remarks. "Tax reform is a once-in-a generation opportunity to boost job creation in America. It should not be squandered to enable more Washington spending. Spending is the problem, spending must be the focus.?

Obama's remarks came a day after he returned to Washington from a three-day golfing weekend in Florida.

Congress is not in session this week, meaning no votes will occur before next week and complicating the ability to negotiate any short-term resolution.

Obama said the anticipated cuts were already having an effect, noting that the Navy had already delayed the deployment of a carrier to the Persian Gulf.

"Changes like this -- not well thought through, not phased in properly -- changes like this effect our ability to respond to threats in unstable parts of the world," he said.

Obama wants to offset the immediate spending cuts, known as a sequestration in budget language, through a combination of targeted spending cuts and increased tax revenue. The White House is backing a proposal unveiled last week by Senate Democrats that is in line with the president's principles.

But that plan has met an icy reception among Republicans, who oppose raising taxes to offset the cuts.? GOP leaders say the president got the tax increases he wanted at the beginning of the year when Congress agreed to raise taxes on family income above $450,000 a year.

Obama called on congressional Republicans to compromise and accept the Senate Democrats' proposal.

The Democrats propose to generate revenue by plugging some tax loopholes. Those include tax breaks for the oil and natural gas industry and businesses that have sent jobs overseas, and by taxing millionaires at a rate of at least 30 percent.

A spokesman for House Speaker John Boehner said the Ohio Republican agrees the sequester is a bad way to reduce spending, but put the onus for averting the cuts on Democrats.

"A solution now requires the Senate -- controlled by the president's party -- to finally pass a plan of their own," spokesman Brendan Buck said.

Meanwhile, a bipartisan proposal Tuesday by co-chairs of an influential deficit-reduction commission called for reducing the deficit by $2.4 trillion over the next 10 years, with much of the savings coming through health care reform, closing tax loopholes, a stingier adjustment of Social Security's cost of living increases and other measures.

The proposal by former Republican Sen. Alan Simpson of Wyoming and Democrat Erskine Bowles, the former chief of staff for President Bill Clinton, calls for about one quarter of the savings to come from changes in health care programs and another quarter from revenue generated by tax changes.

In their plan, Bowles and Simpson say the automatic cuts scheduled for March 1 are too steep and could set back the economy.

"Sharp austerity could have the opposite effect by tempering the still fragile economic recovery. In order to protect the recovery, the sequester should be avoided and deficit reduction should be phased in gradually," they wrote.

Some Republicans, including House Budget Committee Chairman Paul Ryan, R-Wis., have advocated plugging loopholes, but as part of a discussion on a tax overhaul, not sequestration.

"Loopholes are necessary for tax reform," Ryan said Sunday on ABC's "This Week." `'If you take them for spending, you're blocking tax reform and you're really not getting the deficit under control.?

The sequester was first set to begin taking effect on Jan. 1. But as part of the "fiscal cliff" negotiations, the White House and lawmakers agreed to push it off for two months in order to create space to work on a larger budget deal.

With little progress on that front in recent weeks, Obama is calling for the sequester to be put off again, though it's unclear whether another delay would have any impact on the prospects for a broader budget agreement.

Sentencing delayed for Alabama woman in cancer scam

WETUMPKA, Ala. ? Sentencing for a woman charged with lying about her son having cancer to raise money has been delayed until April.

The Montgomery Advertiser reports 23-year-old Stephanie Nicole Jones, of Titus, was supposed to be sentenced today but was hospitalized Wednesday night. Her attorney, Heather Dixon, did not say why Jones was hospitalized.

Jones in October pleaded guilty to a count of theft by deception and attempted theft of property by deception. District Attorney Kristy Peoples says Jones told others her son had cancer and several people and organizations in Elmore County held fundraisers to pay for the boy?s treatment. Authorities say the efforts raised more than $7,500 and Jones used some of it for a trip to Walt Disney World.

The woman?s sentencing is set for April 4.

Cameron suggests using foreign aid cash for military

AMRITSAR, India (Reuters) - Prime Minister David Cameron has raised the possibility of diverting hundreds of millions of pounds from foreign aid to defence and security.

Faced with anger in his ruling Conservative party about further possible defence cuts at a time when he says Britain must spend 0.7 percent of gross domestic product on foreign aid, Cameron told reporters he was interested in exploring ways to use money earmarked for foreign aid for wider security purposes.

He said the department for international development - whose budget for foreign aid is set to top 11 billion pounds by 2015 - already worked closely with the foreign and defence ministries, but that more could be done.

"If you are asking me can they work even more closely together, can we make sure that the funds we have at our disposal are used to provide basic levels of stability and security in deeply broken and fragile states, then I think we should," he told reporters on Wednesday during a visit to India.

"Can we do more, can we build on this approach? I am very open to ideas like that."

Britain deploys thousands of troops in Afghanistan and his comments could allow the government to use funds originally intended for foreign aid for what it regards as peace keeping, easing the strain on public finances.

That might placate some MPs in Cameron's party who regularly ask him how he can justify spending so much on foreign aid at a time when Britain's budget crunch is forcing the closure of hospitals, fire stations and police stations.

Britain's gross government debt was 89 percent of GDP in 2012, up from 44 percent in 2007, according to the International Monetary Fund's World Economic Outlook database.

(AP) ? The link between the gunman in a series of deadly California shootings and the woman police say was his first victim remained a mystery Thursday as detectives struggled to piece together the threads of the bizarre and fast-moving rampage.

Homicide detectives were trying to determine how the shooter, 20-year-old Ali Syed, knew his first victim, a 20-year-old aspiring actress named Courtney Aoki, said Orange County sheriff's spokesman Jim Amormino.

Deputies found Aoki dead of multiple gunshot wounds at 4:45 a.m. Tuesday at the home Syed shared with his parents.

As Syed's parents placed a panicked 911 call, Syed sped away in their black SUV and went on to kill two drivers during carjackings, shoot up cars on a busy freeway interchange and injure at least three others before shooting himself in the head, police said.

Investigators will comb through computer and cellphone records for clues about how Aoki met Syed, how she got to the house and what she did for a living, said Amormino. Syed's parents did not recognize Aoki, he said.

Aoki and her mother lived in several Southern California cities in recent years, according to public records, but she was not living with her mother or attending school at the time she died, Amormino said.

Her mother did not return a message seeking comment.

Police described Syed as a video-game playing loner who was unemployed and lived with his parents in an upscale development in the southern Orange County suburb of Ladera Ranch, about 55 miles southeast of Los Angeles.

He was enrolled in one community college course, an introduction to computer repairs class at Saddleback College.

Syed kept to himself and sat in the back, but was a good student with an affinity for the material, said his instructor, Eugene Evancoe.

"It's a complete surprise to me," he said. "He didn't do anything to raise concern or alarm."

Police have said Syed had no criminal history or history of mental illness and there is no evidence of illegal drug use.

NASA deciphering the mysterious math of the solar wind

Feb. 21, 2013 ? Many areas of scientific research -- Earth's weather, ocean currents, the outpouring of magnetic energy from the sun -- require mapping out the large scale features of a complex system and its intricate details simultaneously.

Describing such systems accurately, relies on numerous kinds of input, beginning with observations of the system, incorporating mathematical equations to approximate those observations, running computer simulations to attempt to replicate observations, and cycling back through all the steps to refine and improve the models until they jibe with what's seen. Ultimately, the models successfully help scientists describe, and even predict, how the system works.

Understanding the sun and how the material and energy it sends out affects the solar system is crucial, since it creates a dynamic space weather system that can disrupt human technology in space such as communications and global positioning system (GPS) satellites.

However, the sun and its prodigious stream of solar particles, called the solar wind, can be particularly tricky to model since as the material streams to the outer reaches of the solar system it carries along its own magnetic fields. The magnetic forces add an extra set of laws to incorporate when trying to determine what's governing the movement. Indeed, until now, equations for certain aspects of the solar wind have never been successfully devised to correlate to the observations seen by instruments in space. Now, for the first time, a scientist at NASA's Goddard Space Flight Center in Greenbelt, Md., has created a set of the necessary equations, published in Physical Review Letters on Dec. 4, 2012.

"Since the 1970s, scientists have known that movement in the solar wind often has the characteristics of a kind of wave called an Alfv?n wave," says Aaron Roberts, a space scientist at Goddard. "Imagine you have a jump rope and you wiggle one end so that it sends waves down the rope. Alfv?n waves are similar, but the moving rope is a magnetic field line itself."

The Alfv?n waves in this case tended to have great consistency in height -- or amplitude, which is the common term when talking about waves -- but they are random in direction. You might think of it like a jump rope twirling, always the same distance from center, but nonetheless able to be in many places in space. Another way scientists have envisioned the waves is as a "random walk on a sphere." Again, always the same distance from a given center, but with a variable placement.

Such metaphorical descriptions are based on what instruments in space have, in fact, observed when they see magnetic waves go by in the solar wind. But it turns out that the equations to describe this kind of movement -- equations necessary to advance scientific models of the entire system -- were not easily found.

"The puzzle has been to figure out why the amplitude is so constant," says Roberts. "But it's been very difficult to find equations that satisfy all the characteristics of the magnetic field."

Similar waves are, in fact, seen in light, known as polarized waves. But magnetic fields have additional constraints on what shapes and configurations are even possible. Roberts found a way to overlap numerous waves of different wavelengths in such a way that they ultimately made the variation in amplitude as small as possible.

To his surprise, the equations Roberts devised matched what was observed more closely than he'd expected. Not only did the equations show waves of constant amplitude, but they also showed occasional random jumps and sharp changes -- an unexplained feature seen in the observations themselves.

"Overlapping the waves in this way gives us a way of writing down equations that we didn't have before," says Roberts. "It also has this nice consequence that it is more realistic than we expected, since it shows discontinuities we actually see in the wind. This is important for simulations and models where we want to start with initial conditions that are as close to the observed solar wind as we can get."

Of course, having an equation doesn't yet tell us the reason why the waves in the solar wind are shaped in this way. Nonetheless, equations that describe how the waves move open the door to increasingly accurate simulations that may well help explain such causes. By alternately improving models and improving observations, scientists continue the cyclic nature of such research, until just what physical action on the sun causes these curiously-shaped Alfv?n waves someday becomes clear.
